1. Description of the service
insta ID is a mobile application that lets a holder of a valid Montenegrin electronic ID card (eLK) read data from the NFC chip of the card, electronically sign PDF documents with the qualified certificate on the chip, log in to government e-service portals that accept card-based authentication, scan documents into PDF and manage the card's PIN and PUK codes. The application is developed and published by Bitsync d.o.o.
2. Eligibility
The application is intended for adult holders of a valid Montenegrin electronic ID card. The application is not intended for children. By using the application you confirm that you are at least 18 years old and that you hold a valid card issued by the competent authority of Montenegro.
3. Acceptable use
You will use the application only for lawful operations on your own card. You will not: run NFC sessions in an automated or scripted manner; attempt to read another person's card without their knowledge and consent; use the application to circumvent the security mechanisms of any portal; reverse-engineer the application beyond what is permitted by Montenegrin and European law; resell, rent or sublicense the application to third parties for commercial use without written authorization.
4. What insta ID is not
insta ID is not a certificate issuer. The signing and authentication certificate is issued by the competent national authority (the national certification service) and lives on the chip of your card. Bitsync d.o.o. does not escrow private keys, does not provide cloud signing, and does not act as a qualified trust service provider. insta ID is a technical tool that lets you, as the user, initiate operations that your card and the competent authority already support.
5. Your data and processing
Personal data from the chip and the content of documents stay on your device, unless you yourself initiate an action that shares them (for example logging in to a portal, sending a signed PDF, or sharing a QR identity). Our Privacy Policy describes processing in detail.
6. Intellectual property
All rights in the insta ID application, source code, branding and documentation belong to Bitsync d.o.o. You retain all rights in your own content — your documents, signatures and card identity data. Using the application does not transfer ownership of your data to us.
7. Disclaimer
The application is provided "as is". We make every effort to keep insta ID reliable and secure, but we do not guarantee uninterrupted operation, nor do we accept liability for outages of third-party portals, network disruptions, card defects or the rejection of a signature by the recipient of a document. Whether a signature is legally valid in a specific procedure is determined by the competent authority or by the party receiving the document.
8. Limitation of liability
To the maximum extent permitted by law, Bitsync d.o.o. is not liable for indirect, consequential or incidental damages arising from use of, or inability to use, the application. The aggregate liability of Bitsync d.o.o. on any basis is limited to the amount, if any, that you paid for the application in the 12 months preceding the event giving rise to the claim.
9. Changes to these Terms
We may amend these Terms for legal, security or functional reasons. We will announce material changes inside the application or on instaid.me. Continued use of the application after such notice constitutes acceptance of the amended Terms.
10. Termination
You may stop using the application at any time by uninstalling it. We reserve the right to suspend or terminate access to the services in case of a breach of these Terms or upon a lawful order of a competent authority.
11. Governing law and jurisdiction
These Terms and any dispute arising out of them are governed by the law of Montenegro. The competent court in Podgorica has jurisdiction, save where mandatory consumer-protection rules provide otherwise.
